Abstract

The difference in legal treatment between petty theft and aggravated theft in the context of the Indonesian Criminal Code lies in the severity of the offence and the legal sanctions imposed. Petty theft usually defines cases that result in a small loss, with no violence or threats and is often dealt with lighter penalties, such as fines or relatively short prison sentences, which are contained in Article 362 of the Criminal Code. Meanwhile, aggravated theft includes components such as large losses, the use of violence, or theft under certain aggravating circumstances, and is regulated under articles such as Article 363 and other articles related to aggravation, resulting in harsher penalties and emphasising aspects of deterrence, public protection, and retribution. The research method used uses the literature research method. The results show that petty theft and aggravated theft are regulated with different approaches, reflecting the principle of balance between the need to rehabilitate offenders and the need to protect society from criminal acts. Petty theft, which is considered a less serious act, is punished with lighter sanctions and focuses on rehabilitation.
