Legislative deficiency in regulating the handling contract under Law No. 23-12

Law No. 23-12 dealt with the provisions of the handling contract in a single article within the second section entitled “Handling” of the second chapter related to “Annex and Handling.” However, this discussion was limited or fell short of a comprehensive overview of the various legal aspects of this contract, as the legislator overlooked many of the fundamental issues that emerged from the practical reality, especially with regard to determining the conceptual framework of the handling contract, and the conditions that must be met for the validity of the contract. subcontracting, and the legal implications resulting from it, which makes it necessary to rectify this legislative deficiency through more precise and detailed regulation of the provisions of the handling contract.
