The theory of social risks as a basis for compensation: A study of the concept and elements

This study aims to shed light on the theory of social risks as a basis for compensation, by clarifying the reasons that have led jurisprudence and the judiciary to adopt this theory. It explores the definition of social risk according to doctrinal criteria, explains its characteristics, and proceeds to analyze and elaborate on the essential elements required for the establishment of this theory and for compensating those harmed by such risks. The study concludes that this responsibility is legal in nature, and that compensation based on it exists—or does not exist—strictly in accordance with the legal provision that establishes it.
